The terms, in brief.

These terms govern your use of the Kertik iOS app and its pages on metehanbicer.com, provided by Metehan Biçer, an independent developer based in Türkiye (“the developer”). Because you get the app from the App Store, Apple’s Licensed Application End User License Agreement (EULA) also applies. These terms add to the EULA; where they conflict, the EULA prevails.

I grant you a non-transferable, non-exclusive licence to use Kertik on Apple devices you own or control, for personal, non-commercial purposes, within the App Store Usage Rules. Copying, modifying, reverse engineering or redistributing the app is not allowed, except where the law expressly permits it. The app, its icons, images, sounds and texts belong to the developer.

Kertik Pro unlocks extra features such as unlimited habits, the full-year board and stats, automatic checks from Apple Health, Lock Screen widgets, 8 extra colours and spreadsheet export (CSV). It is available in three ways:

• Yearly subscription: starts with a 7-day free trial, then renews every year.
• Monthly subscription: renews every month.
• Lifetime: a one-time payment, not a subscription.

Payment is charged to your Apple account when you confirm the purchase. To move your purchase to a new device, use “Restore purchases” on the Kertik Pro screen or under Settings › Support. The free features stay available whether or not you buy Pro.

The yearly subscription starts with a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, the yearly price is charged to your Apple account when it ends and the subscription begins. If you buy another plan during the trial, the rest of the trial ends. Under Apple’s rules, a free trial may be offered once per Apple account.

• A subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
• Your Apple account is charged for renewal within 24 hours before the end of the current period.
• You can manage and cancel your subscription on your iPhone under Settings › your name › Subscriptions, or in your Apple ID settings. Cancellation takes effect at the end of the current period; Pro stays active until then.
• Deleting the app does not cancel your subscription.

The lifetime plan is a one-time payment. It does not renew and there is no subscription to cancel. Kertik Pro features stay available on the Apple account you bought them with for as long as the app is offered on the App Store and supported on your device.

Current prices are shown in the App Store before you buy and vary by country or region. If a subscription price changes, you will be told in advance under Apple’s rules, and asked to agree to the new price where Apple’s rules require it. If you don’t accept the new price, you can cancel before the renewal date.

All payments are taken by Apple, so Apple handles refund requests. As the developer I can’t issue refunds directly. To request one, use reportaproblem.apple.com. Your statutory rights as a consumer are not affected.

Kertik is a tool that helps you keep track of habits you choose. It is not a medical device; it does not diagnose or treat anything and does not give medical advice.

• Streaks, percentages and the board are simple counts of your own marks.
• Values read from Apple Health are only as accurate as the devices that recorded them. Kertik only compares them with the goal you set.
• For important decisions about exercise, sleep, diet or your health, talk to a health professional.

Kertik keeps your habits, marks and notes only on your device; there is no copy on a developer server. If your phone is lost, broken or reset and you have no backup, your records cannot be recovered. Making regular backups and keeping backup files somewhere safe is your responsibility.

You agree to use Kertik lawfully. You are responsible for the files and images you export and share, and agree not to use the app to infringe the rights of others or for unlawful purposes.

Kertik is provided “as is”. I can’t guarantee that the app, its widgets or its reminders will run without interruption or errors, that values read from Apple Health will be correct in every situation, or that your data will never be lost. Rights that the law provides and that cannot be limited are not affected.

To the extent the law allows, the developer is not liable for indirect damages or lost data arising from the use of, or inability to use, Kertik, from a missed reminder, or from decisions made based on information in the app. In any case, total liability is limited to the amount you paid for Kertik in the last 12 months. This limitation does not affect liability for intent or gross negligence, or your rights under consumer protection law.

I may update these terms. I will publish changes on this page and update the effective date. If a change is significant, I will also point it out in the app or on this site. Continuing to use Kertik after a change means you accept the updated terms.

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Türkiye have jurisdiction over disputes; consumers may also apply to consumer arbitration committees and consumer courts within the legal limits. Mandatory consumer protection rules of the country you live in are not affected.
